Over recent years, lawyer misconduct and regulation of the profession have been topics of considerable interest. Yet, when the topic of legal ethics is raised, the focus tends to be on lawyer conduct external to the firm: lawyer conduct in court; lawyer conduct vis-a-vis client; or lawyer conduct vis-a-vis opposing counsel or the judiciary. The recent National Attrition and Re-engagement Study, however, raises a different aspect of legal professional ethics. This Report found a widespread incidence of bullying, intimidation, discrimination and (...) harassment within law firms, primarily affecting though not confined to, female lawyers. Of course, bullying and associated behaviours are not confined to the legal profession. But these behaviours are at odds with a profession that purports to be deeply concerned with the ethical conduct of its members. Arguing that ‘ethics begins at home’, this paper suggests NARS raises uncomfortable questions about legal professional ethics: if law firms cannot treat their own staff members ethically, what does that say about the firm’s approach to ethical conduct more generally? And if this culture is as widespread as the report suggests, what does this say about the ethics of the legal profession as a whole? (shrink)

This article addresses a common yet rarely discussed aspect of hospital care—a pro-active approach to ethical dilemmas. Potential ethical conflicts often present warning signs to clinicians, analogous to the warning lights on a car’s dashboard. Using a recent case study, a commonly encountered clinical decision—a conflict about whether to terminally extubate a critically ill patient versus whether to offer a tracheostomy— we describe a pro-active approach to ethical conflicts and outline three learning objectives: (1) the need for a robust understanding (...) of the term “futility,” (2) the need for an appreciation of the various and often conflicting interpretations of “improved/improving,” and (3) the need to understand the challenges of surrogate decision making. While debate continues over the role of the lawyer in society, this article notes that the recently amended professional conduct rules of both barristers and solicitors and the proposed draft National Law prioritise the duty to the court and the administration of justice. In addition, the Australian Learning and Teaching Council's threshold learning outcomes for legal education corroborate these obligations when they assert that the role of a lawyer includes a professional responsibility to promote justice in service to the community. By referring to Australia's proposed regulatory framework and associated national professional conduct rules, and drawing upon the American Bar Association's Model Rules of Professional Conduct and a body of US literature that refers to lawyers as public citizens, this article will argue that Australian lawyers owe a duty to the public in their everyday dealings with clients. In doing so, this article will refer to some theories of citizenship; and what it means for lawyers, in a practical sense, to act as public citizens. (shrink)

This study ascertained reports of assent (affirmative agreement) and permission (agreement by an adult fully capable of being informed) in 114 children's research articles in 1990 in Child Development (CD), Journal of Consulting and Clinical Psychology (JCCP), Journal of Pediatric Psychology, and Journal of Clinical Child Psychology. Of the research projects, 43% failed to specify permission, and 68.5% failed to specify assent. JCCP reported assent significantly more than CD. Assent was reported significantly more in research with older children than with (...) younger children. This lack of sensitivity to assent and permission suggests that many authors, reviewers, and editors consider reporting assent and permission unessential. We recommend specifying assent and permission in all manuscripts, highlighting children's research issues in graduate training, and using specific safeguards when conducting research with children. ABSTRACTA lawyer's behaviour derives from their own principles and values, the norms of professionalism, the professional conduct rules and the common law. In the past, much emphasis has been placed upon the first two sources as they formed the basis of self-regulation and influenced the development of legal ethics. Recently, the Australian codes of ethics explicitly detail an increasing range of duties which might reasonably have been thought to be implicit characteristics of sound ethical values and professionalism, for example, a (...) duty to be civil, and an explicit prohibition against harassment, intimidation and bullying. Such additions have been deemed necessary as a response to increasing concerns about lawyer incivility and empirical reports detailing high levels of harassment, intimidation and bullying within law firms. We share Roberts and Buckloh's (this issue) concern about issues of assent and permission in research with children and agree that our research cannot conclude legitimately that (a) researchers failed to obtain permission/assent, (b) children were put at risk, or (c) failure to report permission/assent procedures was, in any way, unethical. We never made these conclusions. Rather, we argue that publishing assent and permission would enhance compliance with ethical standards, sensitize researchers and readers to its importance, and shift publishing priorities (...) in an appropriate direction. It was 2003 and she had returned to the DARDAR clinic in her hometown of Dar es Salaam, Tanzania three times that week with vague complaints of various pains and aches. Her doctors were considering whether these symptoms were due (...) to the initiation of her recent treatment with antiretroviral medications for her HIV infection or related to the last administration of the investigational tuberculosis (TB) vaccine that the DARDAR Health Study was evaluating. Fatuma's doctor, Dr. Lillian Mtei, consulted with Dartmouth's chief of Infectious Disease, Dr. Ford von Reyn, who happened to be in Dar that week on a site visit. Neither physician could determine the basis for her symptoms. Dr. Mtei returned to the exam room once more and this time emerged with the answer: Fatuma had just learned that her three year old daughter was HIV-infected, likely contracted from Fatuma during or shortly after she gave birth to her daughter. Even with successful roll out of prevention of mother to child transmission programs in Tanzania, there were nearly 29,000 perinatal infections in 2009. As of December 2010, only 18% of these were enrolled in HIV treatment programs (UNAIDS, 2011; World Health Organization [WHO], 2011). Without antiretroviral therapy (ART), one-half of HIV-infected children will die before their second birthday. Since clinical research to determine efficacy and safety of new medical treatments is conducted almost exclusively in adults, provision of new medical treatments to [End Page 75] children always lags behind advances for adults. Furthermore, children are often underrepresented in programs for antiretroviral drugs for the following reasons: 1) they are not prioritized for care; 2) facilities lack infant diagnostic capabilities; 3) there is limited pediatric HIV training and consequently, a shortage of pediatric providers; and 4) pediatric antiretroviral formulations are frequently unavailable. C'est la voie ésotérique par essence, qui suscitera l'émergence à travers le monde (Europe, Etats-Unis, Russie, etc) d'innombrables"chapelles" initiatiques se réclamant de Guénon, avec notamment les groupes soufis dirigés par Schuon, Vâlsan ou Pallavicini. Chose frappante, un lien inextricable s'est peu à peu tissé entre cette perspective ésotérique et l'horizon politique. En témoignent la "spiritualité héroïque" de Julius Evola dans l'Italie des années trente mais aussi les résonances guénoniennes qu'on découvre dans l'engagement politique de Simone Weil ou de Carl Schmitt. Parallèlement à l'activité des revues Le Voile d'Isis/Etudes Traditionnelles, les apports de Mircea Eliade, d'Henry Corbin ou de Raymond Abellio achèvent de perpétuer le rayonnement guénonien, si controversé soit-il. Cette mise en perspective monumentale de l'oeuvre de René Guénon révèle, de manière décisive, une figure cardinale du XXe siècle et dévoile l'étendue de son rôle dans la construction de la pensée occidentale moderne. Nous sommes soutenus dans notre réflexion par la scène sublime de L’Iliade au chant xxiii où Patrocle apparaît à Achille, terrassé par Sommeil, dans une dernière entrevue entre le vivant et le mort, que (...) seule la Poésie peut mettre en scène. The philosophy of science, I believe, should not be the preserve of senile (...) scientists and of teachers of philosophy who have themselves never so much as understood the contents of a textbook of theoretical physics, let alone done a bit of mathematical research or even enjoyed the confidence of a creating scientist. On the latter count I run no risk: Any reader will see that I am untrained (though not altogether unread) in classroom philosophy. Of no ignorance of mine do I boast, indeed I regret it, but neither do I find this one ignorance fatal here, for few indeed of the great philosophers to explicate whose works hodiernal professors of phil osophy destroy forests of pulp were themselves so broadly and specially trained as are their scholiasts. This article discusses two complementary themes that play an important role in contemporary South African political philosophy: (1) the racist tradition in Western philosophy; and (2) the role of ubuntu in regaining an authentic African identity, which was systematically suppressed during the colonial past and apartheid. These are also leading themes in Mogobe Ramose’s African Philosophy Through Ubuntu. The first part concentrates on John Locke. It discusses the thesis that the reprehensible racism of many founders of liberal political philosophy has (...) lethally infected liberal theory. This view neglects the distinction between genesis and justification. Political liberalism has since cleansed itself of the prejudices of its spiritual ancestors. Liberal human rights exclude racism as a matter of principle. The second part discusses the claim that the ubuntu philosophy provides a better basis for a constitution in a modern society than political liberalism. A major problem is that ubuntu is an essentially contested concept. Some philosophers consider ubuntu to be a moribund notion (Matolino); others see it as a vital concept par excellence. In the latter case, it is elaborated from sundry incompatible political views, ranging from African nationalism (Ramose) via humanist communitarianism (Metz) to liberalism (Mboti). Conclusion: as an essentially contested ideological concept, ubuntu should not be a decisive constitutional standard for the application of state force. In contrast, the constitutional model of political liberalism provides a reasonable alternative, as it is designed precisely to solve the problem of social plurality and ideological contest. At first the confrontation was purely intellectual, as writers on ethical theory (within phi losophy, theology, or other humanistic disciplines) turned their attention to topics from the (...) world of medical practice. Recently the confrontation has grown more intense. The ap pointment of clinical ethicists in hospitals and other health care settings is an accelerating trend in North America. Concomitantly, those institutions involved in training peo ple in clinical ethics have added organized exposure to the world of practice, in the form of placement requirements, to the normal academic course load. In common with other dis ciplines, bioethics has begun to see clinical training as a con dition of didactic theory and apprenticeship. (shrink)

Ribeiro’s Sextus, Montaigne, Hume: Pyrrhonizers is a charming and quirky investigation of his three titular skeptics. It is perhaps best understood as a skeptical investigation of skepticism. By that I mean that, like a good Pyrrhonist, Ribeiro explains how (...) things appear to him without claiming to lay down a doctrine or dogma. His topic is how and why skepticism still matters (7). And he suggests that those who are moved by skeptical arguments can learn intellectual modesty from them and thereby achieve a degree of philosophical “calmness of soul” (141).Ribeiro approaches his three figures by taking the cogency of their skeptical arguments for granted. There is little investigation of why these philosophers call various beliefs into question, and his concern is rather what remains once the skeptical doubts are taken on board. Because what he calls “Pyrrhonizing” philosophers reveal that large swaths of our beliefs lack epistemic merit, they also show us how we are not fully rational creatures in our everyday lives. In the case of Sextus, Ribeiro’s focus is on the famous question of whether skeptics can live their skepticism once they have actually suspended all belief. With Sextus, as with Montaigne and Hume, Ribeiro opts for the more radical of the interpretive options; he is not persuaded by Michael Frede’s suggestion that Pyrrhonists restrict their suspension only to abstruse matters, not the everyday (51). But even if we follow the “four-fold way” (20–23) that Sextus offers us as guides for life—the directives of nature, feelings, custom, and expertise—Ribeiro still thinks we will inevitably fall back into belief. He concludes that the original Pyrrhonists should be read aspirationally: insofar as we develop our capacities [End Page 517] to argue on both sides of every question and thus are able to suspend judgment, to that extent we will achieve tranquility. In the case of Montaigne, Ribeiro focuses on his Christian fideism. Once he recognizes the incapacity of reason to resolve intellectual problems, he falls back on faith. And Ribeiro argues that the Catholic flavor of this faith is simply a reflection of Montaigne’s surroundings. In a different community, he could just as easily have embraced a different faith. The heart of the book concerns Hume, whom Ribeiro discusses in three chapters, as opposed to the one each devoted to Sextus and Montaigne. In keeping with his interpretive preferences, Ribeiro’s Hume is a radical skeptic, though he acknowledges the significant yet “utterly perplexing” (95n22) naturalist strains that are also present. Ribeiro takes the resulting tension to be insoluble (98), though I was not convinced. Consider that, in both the Treatise and the Enquiry, Hume uses causal reasoning to investigate causal reasoning. He learns that our ideas are caused by prior impressions; that repeated experience of conjoint events causes us to associate our ideas of similar events; and so on. In the Treatise, he concludes the argument that association is at the root of such causal reasoning by presenting a set of rules, a “logic,” for it. The argument is not as such skeptical, though when Hume “recasts” it in the first Enquiry, he does so in terms of “sceptical doubts” and a “sceptical solution.” In the Treatise, “total” and “extravagant” skepticism come into play only as “systems of philosophy” that Hume uses to shed light on his own core commitments. The problem, I think, is that Ribeiro tends to read Hume a little too literally, as if he is himself falling prey to the skeptical upheaval of the conclusion to the first book of the Treatise, or the final section of the first Enquiry. But I would suggest that Hume is rather deploying the rhetoric of skepticism in these discussions, using it for his ultimate philosophical ends (a point that is especially clear in Ribeiro’s favorite of Hume’s works, the Dialogues). He is showing his reader how his naturalistic philosophical project is itself rooted in human nature, and thus does not yield insight into the intrinsic structure of... (shrink)

On history and political studies in Vietnam.

Scholars have emphasized that decisions about technology can be influenced by philosophy of technology assumptions, and have argued for research that critically questions technological determinist assumptions. Empirical studies of technology management in fields other than K-12 education provided evidence that philosophy of technology assumptions, including technological determinism, can influence the practice of technology leadership. A qualitative study was conducted to a) examine what philosophy of technology assumptions are present in the thinking of K-12 technology leaders, b) investigate how the assumptions (...) may influence technology decision making, and c) explore whether technological determinist assumptions are present. The research design aligned with Corbin and Strauss qualitative data analysis, and employed constant comparative analysis, theoretical sampling, and theoretical saturation of categories. Subjects involved 31 technology directors and instructional technology specialists from Virginia school districts, and data collection involved interviews following a semi-structured protocol, and a written questionnaire with open-ended questions. The study found that three broad philosophy of technology views were widely held by participants, including an instrumental view of technology, technological optimism, and a technological determinist perspective that sees technological change as inevitable. The core category and central phenomenon that emerged was that technology leaders approach technology leadership through a practice of Keep up with technology (or be left behind). The core category had two main properties that are in conflict with each other, pressure to keep up with technology, and the resistance to technological change they encounter in schools. The study found that technology leaders are guided by two main approaches to technology decision making, represented by the categories Educational goals and curriculum should drive technology, and Keep up with Technology (or be left behind). As leaders deal with their perceived experience of the inevitability of technological change, and their concern for preparing students for a technological future, the core category Keep up with technology (or be left behind) is given the greater weight in technology decision making. The researcher recommends that similar qualitative studies be conducted involving technology leaders outside Virginia, and with other types of educators. It is also recommended that data from this or other qualitative studies be used to help develop and validate a quantitative instrument to measure philosophy of technology assumptions, for use in quantitative studies. Letters to Doubting Thomas is an exchange of letters between two characters on the existence of God; it provides a cumulative case for Theism (the belief that God exists). Chapter by chapter, theism is compared with Naturalism (roughly, the view that there is no God and that ultimate reality is physical reality), concluding that Theism (on balance) provides a better explanation of the world and human life than does Naturalism.

Multiple different understandings and uses exist of what granularity is and how to implement it, where the former influences success of the latter with regards to storing granular data and using granularity for reasoning over the data or information. We propose a taxonomy of types of granularity and discuss for each leaf type how the entities or instances relate within its granular level. Such unambiguous distinctions can guide a conceptual modeler to better distinguish between the types of granularity and the (...) software developer to improve on implementations of granularity.
